ESG reporting rules in North America

In North America, the strongest requirements come from California, where SB 253 and SB 261 apply to large companies doing business in the state. Canada has published voluntary ISSB-based standards. Many companies also report voluntarily through CDP and GRI to meet investor and customer requests.

  • California SB 253 and SB 261

SB 253: companies over $1 billion revenue doing business in California report Scope 1 and 2 emissions, with the first report due 10 November 2026. SB 261, a climate risk report, is paused by a court injunction.

Common questions

Do US companies have to report emissions?

Not federally, but California’s SB 253 requires companies over $1 billion revenue that do business in California to report Scope 1 and 2 emissions, with the first report due 10 November 2026. “Doing business in California” has a specific legal meaning, so confirm it with an adviser.
